Terms of Use & End-User License Agreement

These Terms govern your use of Hera Baby Tracker (the “App”), operated by Alperen Aydın. By downloading or using the App you agree to these Terms. If you do not agree, do not use the App. You must be at least 18 years old (or the age of majority where you live) to use the App.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
2. Subscriptions & billing
- Premium is offered as an auto-renewable subscription (e.g. monthly or yearly). The price and billing period are shown in the App before you confirm.
- Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
- The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
- You can manage or cancel your subscription anytime in your App Store / Google Play account settings.
- If a free trial is offered, it automatically converts to a paid subscription unless cancelled before it ends; any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple or Google under their respective policies; we do not process payments or refunds directly. Deleting your account does not automatically cancel a subscription — cancel it in your store account to stop billing.
3. Health disclaimer — please read
Hera Baby Tracker is an informational tracking tool only and does not provide medical advice, diagnosis or treatment. Growth charts (including WHO percentiles), temperature, medication and other logs are for your reference and are not a substitute for professional medical judgment. Always consult a qualified healthcare professional for any questions about your baby’s health. Never disregard professional advice because of something in the App.
4. Your content & conduct
- You retain ownership of the photos and information you add. You confirm you have the right to upload them.
- You agree not to use the App for unlawful purposes or to upload content that is illegal or infringes others’ rights.
- You are responsible for anyone you invite to your shared account; they gain full access to your account’s data.
5. Intellectual property
The App, its design and content (excluding your own data) are owned by us and protected by applicable laws. You may not copy, modify, reverse engineer or distribute the App except as permitted by law.
6. Disclaimer of warranties
The App is provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free or that data will never be lost.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for any loss of data, arising from your use of the App.
8. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate access if you violate these Terms.
9. App stores (Apple & Google)
- This agreement is between you and us, not with Apple or Google. Apple and Google are not responsible for the App or its content.
- Apple and Google have no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and (for iOS) Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
- We, and not Apple or Google, are responsible for addressing any claims relating to the App, including product-liability claims, any failure to conform to legal or regulatory requirements, and claims arising under consumer-protection or intellectual-property law.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with the applicable App Store / Google Play terms of service when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory consumer-protection provisions of the law of your country of residence.
11. Changes
We may update these Terms; continued use after changes means you accept the updated Terms. The “Last updated” date reflects the latest version.

Kullanım Şartları ve Son Kullanıcı Lisans Sözleşmesi

Bu Şartlar, Alperen Aydın tarafından işletilen Hera Bebek Takip (“Uygulama”) kullanımını düzenler. Uygulamayı indirerek veya kullanarak bu Şartları kabul edersiniz. Kabul etmiyorsanız Uygulamayı kullanmayın. Uygulamayı kullanmak için en az 18 yaşında (veya yaşadığınız yerdeki reşitlik yaşında) olmalısınız.
1. Lisans
Bu Şartlara tabi olarak, Uygulamayı kişisel ve ticari olmayan kullanımınız için kullanmanıza yönelik sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz.
2. Abonelikler ve faturalandırma
- Premium, otomatik yenilenen abonelik olarak sunulur (örn. aylık veya yıllık). Fiyat ve faturalandırma dönemi, onaylamadan önce Uygulamada gösterilir.
- Ödeme, satın alma onayında Apple App Store veya Google Play hesabınızdan tahsil edilir.
- Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal etmediğiniz sürece aynı süre için otomatik olarak yenilenir.
- Aboneliğinizi istediğiniz zaman App Store / Google Play hesap ayarlarınızdan yönetebilir veya iptal edebilirsiniz.
- Ücretsiz deneme sunulduysa, bitmeden iptal edilmediği sürece otomatik olarak ücretli aboneliğe dönüşür; abonelik satın aldığınızda denemenin kullanılmayan kısmı geçersiz olur.
- İadeler, Apple veya Google tarafından kendi politikaları kapsamında yönetilir; ödemeleri veya iadeleri doğrudan biz işlemeyiz. Hesabınızı silmek aboneliği otomatik olarak iptal etmez — faturalandırmayı durdurmak için mağaza hesabınızdan iptal edin.
3. Sağlık sorumluluk reddi — lütfen okuyun
Hera Bebek Takip yalnızca bilgilendirme amaçlı bir takip aracıdır ve tıbbi tavsiye, teşhis veya tedavi sağlamaz. Gelişim grafikleri (DSÖ persentilleri dahil), ateş, ilaç ve diğer kayıtlar yalnızca referans içindir ve profesyonel tıbbi değerlendirmenin yerine geçmez. Bebeğinizin sağlığıyla ilgili her soru için mutlaka nitelikli bir sağlık uzmanına danışın. Uygulamadaki bir bilgi nedeniyle profesyonel tavsiyeyi asla göz ardı etmeyin.
4. İçeriğiniz ve davranışınız
- Eklediğiniz fotoğrafların ve bilgilerin mülkiyeti sizde kalır. Bunları yükleme hakkına sahip olduğunuzu beyan edersiniz.
- Uygulamayı yasa dışı amaçlarla kullanmamayı veya yasa dışı ya da başkalarının haklarını ihlal eden içerik yüklememeyi kabul edersiniz.
- Paylaşılan hesabınıza davet ettiğiniz herkesten siz sorumlusunuz; bu kişiler hesabınızdaki verilere tam erişim kazanır.
5. Fikri mülkiyet
Uygulama, tasarımı ve içeriği (kendi verileriniz hariç) bize aittir ve ilgili yasalarla korunur. Yasaların izin verdiği durumlar dışında Uygulamayı kopyalayamaz, değiştiremez, tersine mühendislik yapamaz veya dağıtamazsınız.
6. Garanti reddi
Uygulama, yasaların izin verdiği azami ölçüde, herhangi bir garanti olmaksızın “olduğu gibi” ve “mevcut haliyle” sunulur. Uygulamanın kesintisiz veya hatasız olacağını ya da verilerin asla kaybolmayacağını garanti etmeyiz.
7. Sorumluluğun sınırlandırılması
Yasaların izin verdiği azami ölçüde, Uygulamayı kullanmanızdan kaynaklanan dolaylı, arızi veya sonuçsal zararlardan ya da veri kaybından sorumlu değiliz.
8. Fesih
Uygulamayı kullanmayı bırakabilir ve hesabınızı istediğiniz zaman silebilirsiniz. Bu Şartları ihlal etmeniz halinde erişimi askıya alabilir veya sonlandırabiliriz.
9. Uygulama mağazaları (Apple ve Google)
- Bu sözleşme sizinle bizim aramızdadır, Apple veya Google ile değildir. Apple ve Google, Uygulamadan veya içeriğinden sorumlu değildir.
- Apple ve Google’ın Uygulama için herhangi bir bakım veya destek sağlama yükümlülüğü yoktur.
- Uygulama geçerli bir garantiye uymazsa Apple’ı bilgilendirebilirsiniz ve (iOS için) Apple satın alma bedelini iade edebilir; yasaların izin verdiği azami ölçüde Apple’ın Uygulamaya ilişkin başka bir garanti yükümlülüğü yoktur.
- Apple veya Google değil, biz; Uygulamaya ilişkin her türlü talebi (ürün sorumluluğu talepleri, yasal veya düzenleyici gerekliliklere uymama ve tüketici koruma ya da fikri mülkiyet hukukundan doğan talepler dahil) ele almaktan sorumluyuz.
- ABD Hükümeti’nin ambargo uyguladığı veya “terörü destekleyen” olarak belirlediği bir ülkede bulunmadığınızı ve herhangi bir ABD Hükümeti yasaklı veya kısıtlı taraflar listesinde yer almadığınızı beyan edersiniz.
- Uygulamayı kullanırken ilgili App Store / Google Play hizmet şartlarına uymalısınız.
- Apple ve bağlı kuruluşları bu Şartların üçüncü taraf lehdarıdır ve bunları size karşı uygulayabilir.
10. Geçerli hukuk
Bu Şartlar, kanunlar ihtilafı kurallarına bakılmaksızın Türkiye Cumhuriyeti yasalarına tabidir. Tüketici iseniz bu hukuk seçimi, yaşadığınız ülkenin emredici tüketici koruma hükümlerinin sağladığı korumadan sizi yoksun bırakmaz.
11. Değişiklikler
Bu Şartları güncelleyebiliriz; değişikliklerden sonra kullanmaya devam etmeniz güncel Şartları kabul ettiğiniz anlamına gelir. “Son güncelleme” tarihi en güncel sürümü yansıtır.
